These terms apply to all services provided by Bizaccess Advisory (202603241723 (003888465-D)), a sole proprietorship registered in Malaysia (“we”, “us”), of No. 9-1, Jalan Nadchatiram 1, Taman Tayton View, Cheras, 56000 Kuala Lumpur. By accepting a quotation or making payment, you agree to them.
1. Our services
We prepare, screen, submit and follow up applications for licences, permits, approvals and certifications with local authorities and government agencies. We act as your agent and consultant. We are not the approving authority and we do not act as your legal adviser.
2. Quotations
- Quotations are valid for 30 days from the date of issue unless stated otherwise.
- Our fees cover our professional services only. Government, local authority and agency charges (licence, processing, registration, levy, testing, inspection and similar fees) are excluded and are payable separately at cost.
- Where a quotation is marked “to be quoted”, the fee is confirmed in writing before work begins.
- Work outside the quoted scope is quoted separately before it is carried out.
3. Payment
- Fees are payable in full before work begins, unless we agree otherwise in writing.
- Screening fees are credited in full against our fee for the full engagement if you proceed with us.
- Government and agency charges paid by us on your behalf are recharged at cost and are payable on demand.
4. Your responsibilities
- You must provide complete, accurate and genuine documents and information.
- You must tell us of anything that may affect the application, including unapproved renovations, changes of use, outstanding council charges or previous rejections.
- Delays caused by incomplete or inaccurate information are not our responsibility, and any resulting resubmission fee is payable by you.
- You confirm you are authorised to submit the documents you provide.
5. Approvals and timelines
Approval is at the sole discretion of the relevant authority. We do not and cannot guarantee that any application will be approved, or approved within any period. Processing times are estimates based on experience and are outside our control. We are not liable for any loss arising from a rejection, a query or a delay by an authority.
6. Licensed professionals
Certain submissions, including Development Orders, building plans, fire safety submissions and plan endorsements, must by law be made or endorsed by a registered Principal Submitting Person, Professional Engineer or Architect. Where this applies, we coordinate the submission with a registered professional. Their professional services and liability remain their own.
7. Cancellation and refunds
- You may cancel before we begin work, and we will refund what you have paid less any government or agency charges already incurred and any work already carried out.
- Once an application has been submitted to an authority, fees are not refundable.
- We may decline or discontinue an engagement if documents are false or incomplete, if the application is unlawful, or if we are unable to act. In that case we refund fees for work not yet done.
- A rejection by an authority is not a ground for refund.
8. Personal data
We handle your personal data and documents in accordance with our Privacy Notice and the Personal Data Protection Act 2010. Documents you upload are stored in private, access-controlled storage.
9. Confidentiality
We keep your documents and business information confidential, and disclose them only to the relevant authorities, registered professionals and service providers needed for your application, or where required by law.
10. Liability
Our total liability for any claim arising out of our services is limited to the fees you have paid us for the engagement concerned. We are not liable for indirect or consequential loss, including loss of profit, business interruption or loss of opportunity.
11. General
- These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction.
- We may update these terms; the version in force is the one published when your quotation is issued.
- If any clause is unenforceable, the remaining clauses continue to apply.
